PREAMBLE

Both parties agree that their relations will be exclusively governed by this contract, excluding any other condition.

In case a term would be lacking, it would be governed by rules that apply in the field of distance selling companies which have headquarters in France. Denoux company commits itself to comply with all clauses of the Consumer Code relating to distance selling.
SUBJECT
These terms aim at defining the terms of sale between the vendor and the user, from the order to services, through the payment and delivery.
They regulate all the steps necessary for placing the order and keep track of it between the contracting parties.
PRODUCTS
The characteristics of the goods sold on the website Cmonstyl.com are detailed in the product sheet based on information supplied by the manufacturers, and illustrated by photographs: all of this information is not contractual.
In case of error or omission, Denoux company agrees to make any necessary changes having been informed, however, his liability could be engaged.
ORDER AND AVAILABILITY

The goods sold remain the property of the seller until full and effective payment of the price.
PRICE
The prices of our products are indicated in Euros all taxes included, excluding processing fee and shipping.
The seller reserves the right to change prices at any time but the products will be billed based on current rates at the time of order entry.
The prices mentioned on the website are guaranteed within the limit of open stocks.
GUARANTIES
All items are subject to a contractual guarantee, which does not preclude the legal guarantee provided by Article 1641 and following of the French Civil Code. Users benefit of a guarantee which enables to return the defective items delivered, in accordance with articles L 211-4 and following of the French Code of Consumption.
SIGNATURE AND PROOF

These terms are subject to the French law. They have been translated into English.
In the case of litigation with a professional, the case will fall within the jurisdiction of Marseille’s Court.
In the case of litigation with a customer, the case will fall within the jurisdiction of the French Courts.
FORCE MAJEURE
All or part of the obligations held by Denoux company will be suspended in the case force majeure would occur, such as recognized by the French law. Under those circumstances, customers will be notified via email within a 7 days deadline.
MODIFICATION OF GTS
The company Denoux reserves the right to modify these Terms of Sale. New versions of these terms will be posted on the front page of section"My Account". In the event that any of the clause of the general terms of sale would be illegal or unenforceable by a court decision, the other ones shall remain in force. |

Products are shipped by French Post with tracking system.
Delivery times reported during the checkout are indicative and calculated on the basis of processing time and information provided by French Post. They are not commitments and can't lead to order cancellation in case of overruns.
In the event of unusual delay, due to the company Denoux, the customer will be notified by mail.
In case of delay due to force majeure, the delivery time will be extended for the duration of such force majeure, defined for example as: strikes, blockades of roads, rail or air, and facts due to weather.
Tracking number is sent to customer after parcel shipment, in an email summarizing the details of the order. The customer can track the parcel on following website: www.coliposte.net.
Transport risks being borne by the client, he undertakes to verify the content and integrity of the package upon receipt thereof, and to make reservations or making a claim with the postal services within 3 working days after delivery, or even refuse the package if it shows signs of deterioration or appears to have been opened.
In case of missing or defective product, the fault will have to be notified on the receipt day or the first following business day by registered mail to Denoux company's customer service: Denoux, 2 Allée du Carami , 13470 Carnoux. Beyond this period, the company will be relieved of any responsibility and will reserve the right to ask the customer to return the defective product. If the terms previously mentioned are completed, Denoux may: exchange the product, provide a credit note, refund, or send the missing item (depending on the buyer's request legitimacy).
Failure to deliver the parcel, the customer will approach the post office closest to his home and visit www.coliposte.net to determine where the package is.
In case of loss determined by French Post after investigation, Denoux company will refund the order (products and delivery charges).
Any taxes and duties applicable on orders shipped outside of France are the buyer's responsibility, even additional charges resulting from customs inspection.
The company Denoux is not required to inform the client of such charges amount, he has to revert to his country's competent authorities.

RETURN POLICY
In accordance with Articles L.121-20 and following of the French Code of consumption, the user enjoys a period of seven (7) days to exercise its right of withdrawal by returning the ordered goods to the seller without having to justify reasons or to pay penalties except, where applicable, the cost of return. The period of seven days starts from the items receipt day.
Only items returned in their intact original packaging, undamaged and free from any use are accepted.
All returned items will be subject to a refund, a credit note or an exchange, depending on the buyer's choice. In case of dispute, the customer will have to prove the package has been delivered to our office, it implies a return by certified mail.
If a credit note is established, it will be suggested as a payment term on your next order.
